The 45-Day Clock on a Texas Occupational Licence

Texas calls it an occupational driver licence, or an essential need licence. It lets you drive a non-commercial vehicle during a suspension for three purposes only: work, essential household duties, and school-related activities.

You petition a court, not the department

This trips people up immediately. DPS issues the licence, but it does not decide whether you get one. You petition the Justice of the Peace, county or district court where you currently live, or the court of original jurisdiction where the offence happened.

The 45-day window is the real deadline

Once the court is satisfied, you get a signed order. The order is not the licence — but it functions as a driver licence for 45 days from the date the judge signs it while DPS processes your request.

Set that against the other number in this process: DPS asks for 21 business days to process what you send in. Twenty-one business days is about a calendar month. Out of a 45-day window.

So the margin is real but thin, and it disappears entirely if you spend the first two weeks shopping for insurance. Have the SR-22 in hand before the judge signs, not after.

The four things DPS needs

1. A certified copy of the petition and a certified copy of the court order granting the occupational licence.
2. A Financial Responsibility Insurance Certificate — the SR-22.
3. Payment of the occupational licence fee.
4. Payment of all reinstatement fees.

Send everything in one envelope, with your full name, date of birth and driver licence number written on every document, and include a copy of your suspension notice if you have one. Pay the fees online through License Eligibility if you can — that clears in roughly 24 to 48 hours instead of going into the 21-day queue.

How long the licence lasts

Typically one year or less, with two years the maximum. Anything beyond one year has to be granted by the court, not requested from DPS.

Who cannot get one

Three exclusions, and the first one ends the conversation for a lot of people:

1. It cannot be issued to operate a commercial motor vehicle during a suspension, revocation, cancellation, disqualification or denial. CDL holders do not have this route.
2. It is not available where the licence is revoked or denied as incapable following a medical advisory board case.
3. It is not available for a delinquent child support revocation.

If none of those apply to you, the occupational licence is usually the difference between keeping a job and losing one. Get the insurance side handled first so it is never the thing holding up the order.
